Facilities Required to Apply

Industrial facilities that require this permit are those new or existing facilities that:

  1. Conduct any activities listed in Table 1 AND discharge stormwater from the facility to a surface water body, or to a storm sewer system that discharges to a surface water body;
  2. Facilities that have an existing NPDES permit which does NOT address all stormwater discharges that are associated with the industrial activity
  3. Any inactive facility listed under 40 CFR subpart 122.26(b)(14) where significant materials remain onsite and are exposed to stormwater.

Ecology can require additional facilities to obtain a permit if it determines that:

  1. It is a significant contributor of pollutants to the waters of the state, including ground water;
  2. It may reasonably be expected to cause a violation of any water quality standard;
  3. It conducts industrial activities (or has a SIC code) with stormwater characteristics similar to those in Table 1.

Definitions

Surface waters of the state: include lakes rivers, ponds, streams, inland waters, salt waters, and all other surface waters and water courses within the jurisdiction of the state.

Stormwater Discharge Associated with Industrial Activity: Means the discharge from any conveyance that is used for collecting and conveying stormwater and that is directly related to manufacturing, processing or raw materials storage areas at an industrial plant (40 CFR 122(b)(14)).
