Terminating Upon Completion

The Department of Ecology may approve a Notice of Termination (NOT) request provided the permittee meets one OR more of the following conditions:

  • All permitted stormwater discharges associated with industrial activity (authorized by this permit) end because the industrial activity has ended and no significant materials or pollutants remain exposed to stormwater.
  • The party responsible for permit coverage sells or otherwise legally transfers responsibility for the industrial activity.
  • All discharges associated with industrial activity are prevented because the stormwater is redirected to a sanitary sewer or discharged to the ground.

Permit fees will continue until the Department of Ecology receives a completed NOT form and the NOT is granted.

To obtain a permit termination you must apply for the NOT using the DOE’s NOT form, sign it (according to permit specifications), and submit it to:

How do I transfer coverage under the permit?

If the previous facility operator has obtained this permit, it shall automatically transfer to the new discharger if the following conditions are met:

  • The existing discharger and the new discharger submit a complete, written, and signed Transfer of Coverage form that specifies the date of transfer of permit responsibility, coverage, and liability.
  • The type of industrial activities and practices remain substantially unaltered.
  • The DOE does not notify the permittee of the need to submit a new application.
  • The DOE does not notify the existing discharger and new discharger of its intent to revoke permit coverage.

How do I modify permit coverage?

If you are anticipating a significant process change, or otherwise requesting a modification of permit coverage you must submit a complete Modification of Coverage Form to the Department of Ecology. You must

  • Apply for modification of coverage at least 60 days prior to implementing the significant process change.
  • Complete the public notice requirements (See page 6).
  • Comply with SEPA as part of the complete modification of coverage if your facility is undergoing a significant process change.
