Facilities Excluded from Coverage
The Department of Ecology’s Industrial Stormwater General Permit will NOT cover the following facilities:
- Any part of a facility that has a stormwater discharge subject to stormwater Effluent Limitations Guidelines, New Source Performance Standards, or Toxic Pollutant Effluent Limitations-these facilities must apply for NPDES permit coverage as an individual or industry-specific general permit.
- Nonpoint source silvicultural activities with natural runoff.
- Facilities operated by any department, agency, or instrumentality of the executive, legislative, and judicial branches of the Federal Government of the United States, or another entity, such as a private contractor, performing industrial activities for any department, agency or instrumentality.
- Facilities located on Tribal lands OR facilities that discharge to receiving waters subject to water quality standards of Indian Tribes.
- Facilities authorized to discharge stormwater associated with industrial activities under an existing NPDES individual or other general permit.
- Construction activities-operators must seek permit coverage under the Construction Stormwater General Permit or an individual permit.
- Facilities that discharge to a water body with a control plan, UNLESS this general permit provides the level of protection necessary under the control plan.
- New dischargers to a water body listed on the 303(d) list of the CWA UNLESS the permittee meets the requirements of Condition S6.B in the ISWGP.
- Hazardous waste landfills subject to 40 CFR Part 445, Subpart A.
